General Terms & Conditions of Sale

INTRODUCTION 

These General Terms and Conditions of Sale (hereinafter "Terms and Conditions") govern the access, use, and purchases made through the e-commerce platform available on the websites afterhall.pt and afterhall.com (hereinafter "Website"), owned by AFTER HALL, LDA, NIPC 517756790, with its registered office at Rua da Embra, s/n, 2430-108 Marinha Grande (hereinafter "After Hall"). 

By accessing and using the Website, the User (any person browsing and interacting with the Website) agrees to these Terms and Conditions. We recommend a careful reading, as they contain important information about the User’s rights and obligations and constitute a binding agreement between the User and After Hall. 

After Hall reserves the right to update or modify these Terms and Conditions at any time, without prior notice. Therefore, we advise the User to regularly consult this page to stay informed of any changes.

Please note that Portuguese public holidays are not considered working days. 

1. GENERAL TERMS 

1.1. By placing an order on the Website, the Customer declares that: 
      • They have read and accepted these Terms and Conditions, confirming their knowledge and acceptance by clicking "I have read and accept the General Terms and Conditions of Sale" before proceeding to checkout;
      • They agree that the personal data requested will be used to process and ship the order, improve their experience on the Website, and for other purposes described in our Privacy Policy;
      • They are at least 18 years old or of legal age in the jurisdiction of their residence and agree to use their own payment methods;
      • They agree to use the Website appropriately and legally, in compliance with applicable legislation. 

1.2. After Hall's e-commerce services are exclusively available to end consumers (hereinafter "Customer"). If you are not an end consumer and wish to make a purchase on the Website, please contact us through the means mentioned in the Introduction to these Terms and Conditions. 

1.3. After Hall reserves the right not to process orders from users who are not end consumers or who do not comply with these Terms and Conditions.

1.4. The Customer must provide After Hall with a correct and complete email address and other contact details, accepting that After Hall may contact them, if necessary, through these details. 

2. PRICES AND PRODUCTS 

2.1. All products available on the Website are described as accurately as possible on their respective product pages. The User should carefully read the product descriptions and specifications and, in case of doubt, contact After Hall using the means mentioned in the Introduction to these Terms and Conditions. 

2.2. The prices displayed on the Website are in Euros (€) and include VAT at the legal rate in force on the date of purchase. 

2.3. After Hall reserves the right to change prices and product specifications without prior notice. 

2.4. After Hall does not sell second-hand products or products that do not meet market quality standards. 

3. PURCHASING PROCESS 

3.1. It is possible to make a purchase without creating a customer account. If the Customer chooses not to create an account, they will need to provide the required data at the time of order placement. 

3.2. All information about past orders is available in the customer area, accessible on desktop devices (computers and laptops) by clicking on the second icon in the top right corner of any page on the Website, or on mobile devices through the last icon in the bottom right corner. 

3.3. To ensure a full browsing experience, the User's browser must allow cookies and pop-ups. 

3.4. The purchasing process follows the following steps: 

      • Select the desired product on the respective product page; 
      • Add the product to the cart by clicking "Add to cart"; 
      • After adding the item, a cart preview will appear, allowing you to proceed to checkout, view the cart, or continue selecting other items by closing the preview; 
      • To complete the purchase, click on "I have read and agreed with the Terms and Conditions" and then on "CHECK OUT". You will be redirected to the checkout page; 
      • Fill in the requested details and choose the desired payment method; 
      • If you have a promotional code, enter it at this stage; 
      • Check if all the information is correct and click "Review order"; 
      • After confirming the details, select "Pay now".
      • Depending on the chosen payment method, you will be redirected to the respective payment page. For more information on payment methods, refer to section "4. Payment Methods".
      • Once the process is complete, a message with the order details will appear, and a confirmation email will be sent to the provided email address. We recommend saving this email for future reference. 

3.5. After Hall reserves the right to refuse or cancel the order, even after automatic confirmation. The Customer will be informed in case of cancellation. 

4. PAYMENT METHODS 

4.1. The payment methods accepted by After Hall are: 

      • Debit or credit card (Visa, Mastercard, American Express, and UPI);
      • PayPal; 
      • MB Way; 
      • ATM (Multibanco) Reference. 

4.2. For payments by Multibanco Reference, the Customer has 1 day (24 hours) to complete the payment. If the payment is not made within this period, the order will be cancelled. 

4.3. For payments via MBWay, the Customer has 4 minutes to authorize the transaction in the application. If payment is not completed within this timeframe, the order will be cancelled. 

4.4. Costumer’s personal payment details are not visible or stored by After Hall. The company only receives payment confirmation and has no access to the Customer's personal data related to the payment method. 

5. SHIPPING & DELIVERY 

5.1. After order confirmation, After Hall will ship the items as quickly as possible, depending on their availability. The Customer will be informed of the estimated delivery date and can track the shipment status through the link provided in the shipping notification email. 

5.2. We ship to mainland Portugal and mainland Spain. For deliveries outside these regions, please contact us using the details provided in the Introduction section of these Terms and Conditions. 

5.3. Shipping Costs: 

After Hall offers free shipping on all orders to mainland Portugal and mainland Spain. 

5.4. Delivery Times: 

      • Orders confirmed and paid for by 3:00 pm on a working day will be delivered by 7:00 pm the next working day for in-stock products and deliveries within mainland Portugal. 
      • Orders confirmed and paid for by 3:00 pm on a working day will be delivered within 24 to 48 hours (excluding weekends and public holidays) for in-stock products and deliveries to mainland Spain. 
      • Orders paid via Multibanco Reference will only be dispatched after payment confirmation, which may take between 5 to 7 days. 
      • Items on pre-order or pre-launch have specific delivery times, which are indicated on the product page. 
      • Although every effort is made to meet delivery deadlines, delays may occur during promotions, sales periods, Christmas season, epidemics, or stock shortages. 

5.5. Deliveries are made exclusively on working days, from 9:00 am until 7:00 pm. 

5.6. If an order includes items with different delivery times (e.g., in-stock products and pre-order products), the longer delivery time will apply, unless stated otherwise. 

5.7. After Hall is not responsible for delivery delays or failures caused by events of force majeure, i.e., situations beyond its reasonable control. 

5.8. Claims for undelivered orders must be submitted within a maximum of 30 days from the order date. After this period, After Hall cannot be held liable for any lost parcels. 

5.9. If the first delivery attempt fails (e.g., no one present at the delivery address), the courier will contact the Customer to reschedule delivery at their convenience. 

5.10. After Hall uses professional and accredited courier services to ensure the quality and efficiency of deliveries. 

5.11. After Hall is not responsible for delays attributable to third parties. 

5.12. The items sold by After Hall are packaged to ensure maximum protection during transit. The Customer must inspect the condition of the packaging upon receipt. If any damage is detected, they should contact After Hall immediately using the contact details provided in the Introduction of these Terms and Conditions. 

6. RETURNS, EXCHANGES, AND REFUNDS 

6.1. Order cancellation before shipment: 

      • The Customer may cancel their order provided it has not yet been prepared for dispatch. To do so, they should contact After Hall using the contact details provided in the Introduction section of these Terms and Conditions, mentioning the order number. 
      • If the cancellation is accepted, the Customer will be notified via email or phone, and the order will be cancelled at no cost. 
      • If cancellation is not possible, the order will be shipped. In this case, the Customer can proceed with a return, as described in section 6.6. Return Process. 

6.2. Right to Return: 

6.2.1. The Customer may return any item purchased on the Website within 30 days of receipt, whether due to defects, non-compliance, or dissatisfaction. 

6.2.2. To be eligible for a return, the item must: 

        • Be in the same condition as it was shipped; 
        • Not have been washed, used, or show signs of use; 
        • Be complete (if part of a set, the entire set must be returned); 
        • Be returned in its original packaging, including all accessories or gifts; 
        • Not be personalized or custom-made for the Customer. 

6.2.3. If the Customer received the wrong item, After Hall may request its return before sending the correct product. The Customer should keep the item intact until the issue is resolved. 

6.2.4. To report defects or non-compliance, After Hall may request photos showing the problem. 

6.2.5. If the returned item does not meet these conditions, After Hall reserves the right to refuse the return. 

6.2.6. Return of Gifts: 

If the item the Customer wishes to return was a gift from someone else, the return process must be initiated by the person who made the purchase. 

6.3. Exchanges: 

To exchange an item for a different one, the Customer should return the original item and place a new order for the desired item. 

6.4. Return Costs: 

6.4.1. After Hall will cover the return shipping costs only when the reason for the return is its responsibility (e.g., defective or incorrect item). 

6.4.2. In other cases, if the return is accepted, the amount paid by the Customer will be refunded, minus €5.00 (five euros) to cover return shipping costs. 

6.5. Return Process: 

        • Access your customer account by clicking on the second icon in the top right corner (on desktop) or the last icon in the bottom right corner (on mobile devices); 
        • Enter the email used to make the purchase; 
        • You will receive a one-time access code via email to access your orders; 
        • Select the order and the item(s) you wish to return; 
        • Click on "Request return"; 
        • Fill in the required details and confirm by clicking "Request return" again; 
        • You will receive a confirmation email, and your return will be reviewed; 
        • If your return is approved the collection of the items will be scheduled at the address provided during the purchase. 
        • Once we receive the items at our facilities, they will be inspected to ensure they meet the specified return conditions. 
        • If the items meet the return conditions your return will be accepted, and the refund will be processed. 
        • If the items do not meet the return conditions the refund will not be issued, and the items will be sent back to the address provided by the customer, unless otherwise agreed. 

    6.6. Refund Policy: 

    6.6.1. The refund will be issued within a maximum period of 14 days following the approval of the return. This timeframe may vary, within the mentioned period, depending on the bank or payment method used. 

    6.6.2. After Hall cannot be held responsible for any delays in the refund process due to external factors, such as the Customer’s bank or payment service provider. 

    6.6.3. The refund will be made via the same payment method that the Customer used for the original order, unless otherwise agreed.

    6.6.4. If the returned item does not meet the conditions stipulated in these Terms and Conditions, After Hall reserves the right to refuse the refund, and the Customer will be notified via email or phone. In such cases, the item may be returned to the Customer, and After Hall will not be liable for any costs associated with the reshipment. 

    7. PROMOTIONAL CODES AND CAMPAIGNS 

    7.1. Promotional Codes: 

    7.1.1. When used in accordance with the rules, promotional codes offer discounts, promotions, or other benefits to the Customer, specific to certain products or groups of products, during the period associated with the code/campaign. 

    7.1.2. Promotional codes are exclusive for use on After Hall’s Website and cannot be sold, exchanged, gifted, or used for commercial purposes. 

    7.1.3. To apply a promotional code, the Customer must enter it in the "Promotional Code" field during checkout. The code must be entered exactly as received, including letters, numbers, and special characters. 

    7.1.4. Only one promotional code can be applied per order. 

    7.2. Promotional Campaigns: 

    7.2.1. Promotional campaigns are valid only when displayed on the Website, with the discount or offer, as well as the start and end date of the campaign, clearly indicated. 

    7.2.2. It is not permitted to combine promotional codes with ongoing campaigns or with gift cards. 

    7.2.3. After Hall reserves the right to invalidate or suspend any promotional code or campaign at any time without prior notice. 

    7.2.4. After Hall is not responsible for offers that contain errors or inaccuracies, including incorrect prices. Orders placed under such errors may be cancelled. 

    8. AFTER-SALES / CUSTOMER SUPPORT 

    8.1. After Hall provides an after-sales service, which can be contacted on working days from 9:00 AM to 1:00 PM and from 2:00 PM to 6:00 PM via email at apoioaocliente@afterhall.pt or by phone or Whatsapp at (+351) 917 550 021 (national mobile network call). Please note that Portuguese public holidays are not considered working days.

    9. WEBSITE USAGE 

    9.1. The User agrees to use the Website in accordance with these Terms and Conditions and the applicable laws of Portugal, particularly regarding e-commerce regulations. 

    9.2. Without prejudice to the above, the User may freely browse the Website, provided they do not engage in illegal activities or actions that may violate public order. 

    9.3. The use of the Website for purposes that may harm the interests of After Hall or third parties, or that compromise, damage, or overload the networks, servers, hardware, or software of After Hall or third parties, is expressly prohibited. 

    9.4. The User is particularly prohibited from: 

        • Creating fake accounts or identities, impersonating third parties, or misusing someone else’s identity; 
        • Providing false information, and must ensure that all data provided is complete and accurate; 
        • Using the Website fraudulently or contrary to its intended purpose; 
        • Reproducing, modifying, republishing, or redistributing the Website and its contents (see Clause 11); 
        • Interfering with or compromising the use of the Website in any way or violating applicable network rules, regulations, or policies; 
        • Attempting to access unauthorised content or obtaining information not intentionally made available by After Hall; 
        • Transmitting or providing any content containing viruses, malicious software, or files that could compromise the functionality of any equipment, including software, hardware, or communication devices. 

    9.5. Failure to comply with these provisions may result in the blocking of the User’s account, as well as the initiation of legal action by After Hall. 

    10. LIMITATION OF LIABILITY 

    10.1. After Hall makes every effort to ensure that the information presented on the Website is accurate, up-to-date, and free from errors. However, if any errors are detected, we will correct them as quickly as possible. If the information presented at the time of purchase does not match the characteristics of the item, the Customer is entitled to a return, as stipulated in Clause 6. 

    10.2. The photographs on the Website are for illustrative purposes only. Factors such as the monitor used, colour settings, or internet browser may cause the colours displayed to differ from the actual colours. After Hall cannot be held responsible for such variations, and it is always recommended to consult the detailed characteristics of each item. 

    10.3. Unless otherwise required by law, After Hall shall not be held liable for damages arising from the following circumstances: 

        • Incorrect or improper use of the Website; 
        • Inability to use or unsuitability of the services offered on the Website; 
        • The presence of viruses or malware on the User’s device. 

    10.4. The User is responsible for ensuring that their software, including antivirus and other security measures, is up to date and adequate for the proper use of the Website. 

    10.5. After Hall will only be liable for damages suffered by the Customer if they result from a breach of After Hall’s contractual obligations or applicable legal provisions. 

    10.6. After Hall is not liable for any damages, direct or indirect, resulting from the misuse or improper use of the products purchased on the Website. This includes, but is not limited to, damage caused by: 

        • Incorrect use or handling of the product by the Customer; 
        • Natural wear and tear or misuse of the product; 
        • Unauthorized modifications, repairs, or alterations. 

    10.7. Customers are advised to carefully read the product details and care instructions available on each product’s page. 

    10.8. The limitations of liability do not apply in cases of damage caused by gross negligence or intentional misconduct on the part of After Hall. 

    11. INTELLECTUAL PROPERTY 

    11.1. All content available on the Website, including but not limited to trademarks, text, images, logos, graphics, audio and video, is the exclusive property of After Hall, unless otherwise indicated by reference to its source and/or owner. 

    11.2. All material on the Website is protected by third-party copyright and intellectual property rights. 

    11.3. Reproduction, modification, republishing, or redistribution of any Website content, in whole or in part, is prohibited without prior written consent from After Hall. Requests for permission to use content should be directed to the contacts provided in the Introduction of these Terms and Conditions. 

    12. PRIVACY AND DATA PROTECTION 

    12.1. The Customer's privacy is of utmost importance to After Hall. All personal data collected during the purchasing process will be processed and handled in accordance with applicable data protection laws and After Hall's Privacy Policy, which can be found on the Website. 

    12.2. After Hall collects and processes personal data for the purpose of processing orders, delivering products, and improving the overall shopping experience on the Website. The Customer has the right to access, correct, or delete their personal data at any time, as well as to object to its processing for legitimate reasons. 

    12.3. For more information on how After Hall processes personal data, including the Customer's rights and how to exercise them, please refer to the Privacy Policy available on the Website. 

    13. APPLICABLE LAW AND JURISDICTION 

    13.1. These Terms and Conditions, as well as any sales contracts concluded between After Hall and the Customer, are governed by the applicable Portuguese legislation. 

    13.2. In the event of any dispute arising from the interpretation or execution of these Terms and Conditions, both parties agree to submit to the exclusive jurisdiction of the courts in the district of After Hall’s registered office, without prejudice to any mandatory legal provisions regarding jurisdiction. 

    13.3. Alternatively, the Customer may choose to resolve disputes through extrajudicial means, including mediation or arbitration, as provided by consumer protection legislation. The Customer may also use the European Commission's online dispute resolution platform, available at https://ec.europa.eu/consumers/odr, to resolve disputes with After Hall. 

    13.4. By completing a purchase on the Website, the Customer acknowledges that they have read, understood, and agreed to all provisions outlined in these General Terms and Conditions of Sale.
